Thimphu dzongkhag court’s bench I sentenced a 39-year-old man to three years in prison for selling a vehicle without the owner’s permission.

Bhim Bahadur Biswa from Kadori village in Denchukha, Samtse was convicted for violating section 266 of the Bhutan Penal Code.

The judgment stated that it was a value based sentencing and graded a fourth-degree felony.

Bhim Bahadur Biswa was arrested on May 4 last year after the car owner complained to police that he sold the Hyundai H1 he was driving without her knowledge.

He contended before the court that he sold the car after the owner, before she left abroad, mentioned about selling the car.

He also claimed that few months after the owner left, he found a buyer and discussed with the owner’s sister who said the owner agreed to sell the car if they could fetch Nu 800,000.

Bhim Bahadur Biswa only paid Nu 300,000 and failed to pay the remaining money to the owner although he agreed that he would pay within three days.

He claimed that he paid Nu 50,000 to the owner’s maid but lost the remaining money in Phuentsholing.

OAG’s attorney justified that the owner’s sister only gave the approval to do car maintenance and not sell it.

The attorney also submitted before the court that Bhim Bahadur Biswa sold the car so that he could misuse the money.

The maid, whom the defendant claimed he gave Nu 50,000, said she didn’t know anything about the money.

The judgment stated that the vehicle is in an automobile workshop after police seized it. The court ordered Bhim Bahadur Biswa to handover the car to the owner in the same condition he sold it.
